Please read these Terms and Conditions ("Terms") carefully. These Terms govern your booking of any luxury group tour package (the "Tour" or "Service") with [Legal Entity Name] operating as Haven Travel Club ("Haven," "we," "us," or "our"). By booking a Tour, submitting a deposit, or making any payment toward a Tour, you ("Traveler," "Client," or "you") agree to be bound by these Terms, which constitute the entire agreement between you and Haven.
1. Scope of Agreement and Nature of Service
1.1. Nature of Business
Haven Travel Club acts as a principal Tour Operator that designs, markets, and sells all-inclusive, pre-packaged, escorted group travel experiences. The Tour price covers a bundle of services, including accommodations, group transportation, guided activities, and included meals/tastings, as detailed in the specific Tour Itinerary.
1.2. Independent Suppliers
Haven purchases accommodations, transportation, and other services from various independent third-party suppliers (e.g., hotels, motorcoach companies, wineries, local guides). Haven does not own, manage, or control these suppliers and acts solely as an intermediary in coordinating your Tour components.
2. Booking, Payment, and Cancellation
2.1. Reservation and Deposit
To reserve a spot on a Tour, the Traveler must submit a completed booking form and pay a non-refundable, non-transferable deposit. Receipt of the deposit does not constitute acceptance of the booking, which is confirmed only upon written confirmation from Haven.
2.2. Remaining Payments
The outstanding balance of the Tour Price is due in scheduled installments as follows:
-
Remaining balance due divided by the number of whole months between the deposit and tour date.
-
Final Payment due 30 days prior to the Tour Start Date.
If the final payment is not received by the due date, Haven reserves the right to cancel your reservation and retain all deposits and installment payments previously made.
2.3. Tour Price and Single Supplement
The Tour Price is based on single occupancy. Travelers requesting double occupancy may do so for a discounted rate based on foreign exchange rates, tariffs, and taxes in effect at the time of publication and are subject to change.
2.4. Traveler-Initiated Cancellation and Refunds
All cancellations must be submitted to Haven in writing. The cancellation refund schedule is as follows:
Days Prior to Tour Start Date Refund Policy
91+ Days: Forfeiture of the initial deposit; all other payments refunded.
61–90 Days: Forfeiture of the initial deposit and 50% of the total Tour Price.
0–60 Days: No Refund of the total Tour Price will be issued.
Note: All deposits are non-refundable. Haven is not responsible for any expenses incurred by the Traveler in preparation for the canceled trip (e.g., airline tickets, visa fees, travel insurance).
3. Itinerary Changes and Tour Cancellation
3.1. Itinerary Changes
Haven reserves the right to make minor modifications to the itinerary, transportation, or accommodations as necessary due to unforeseen circumstances, local operational requirements, or to enhance the Tour experience. Haven will endeavor to substitute services of comparable quality. No refunds will be issued for minor itinerary changes.
3.2. Tour Cancellation by Haven
Haven reserves the right to cancel any Tour up to 60 days prior to the Tour Start Date due to force majeure, insufficient bookings (if the minimum group size is not met), or any other factor outside of our control.
In the event of cancellation by Haven, the Traveler will receive a full refund of all payments made to Haven. Haven shall not be liable for any additional costs, including, but not limited to, non-refundable airline tickets, hotels, or other arrangements made by the Traveler.
3.3. Force Majeure
Haven shall not be liable for any failure to perform its obligations where such failure is a result of acts of nature, government restrictions, pandemics, war, terrorism, civil unrest, or any other cause beyond its reasonable control. In such events, the cancellation and refund policy in Section 3.2 will apply.
4. Required Travel Insurance
Travel Insurance is Mandatory. All Travelers are required to purchase comprehensive travel insurance that includes coverage for trip cancellation, interruption, medical emergencies, evacuation, and baggage loss, in the amount of $25,000 USD or more. Proof of valid insurance must be submitted to Haven no later than the Final Payment Due Date. Failure to provide proof of adequate coverage may result in cancellation of your booking without refund.
5. Traveler Conduct and Release of Liability
5.1. Conduct and Safety
By booking a Tour, the Traveler agrees to abide by Haven's Code of Ethics and the reasonable authority of the Tour Guide at all times. Haven reserves the right to remove any Traveler from the Tour, at the Traveler’s own expense and without refund, if the Traveler's behavior, in Haven's sole judgment, is disruptive, incompatible with the general well-being of the group, or violates the Code of Ethics on Inclusivity & Safety.
5.2. Assumption of Risk
The Traveler understands and acknowledges that travel, particularly to remote or unfamiliar locations, involves inherent risks, including illness, injury, death, property damage, and loss. The Traveler voluntarily assumes all such risks.
5.3. Release of Liability and Indemnification
The Traveler agrees to release and hold harmless Haven, its officers, employees, agents, and representatives from any and all liability for personal injury, property damage, or death sustained as a result of participation in the Tour, except in the case of gross negligence or willful misconduct by Haven.
6. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California. Any legal action or proceedings arising out of or relating to these Terms or the Tour shall be brought exclusively in the courts of San Francisco County, California.
